The State Water Resources Control Board’s Office of Chief Counsel has an opening for an Assistant Chief Counsel overseeing the Regional Board Branch 1. The position location is 1001 I Street, 22nd Floor, Sacramento, CA 95814, right in the heart of downtown next to light rail stations and other public transportation. The position is expected to be office-centered, reporting in person to the office a minimum of three days a week.
The State Water Resources Control Board and the nine regional water quality control boards are the principal state agencies for the coordination and control of water quality in the State of California. The regional water quality control boards are the primary planning, permitting, and oversight agencies under the Clean Water Act and Porter-Cologne Water Quality Control Act within their respective jurisdictions. The Office of Chief Counsel Regional Board Branches provide legal counsel to the regional water boards, each of which has one to three attorneys who handle virtually all of the region’s water quality law issues. The practice is varied and interesting. It includes participating in complex administrative adjudications and general representation of the seven-member regional water boards and assisting in civil litigation involving the boards’ decisions.
The Assistant Chief Counsel for Regional Board Branch 1 manages the work of 8 attorneys, ranging from the Attorney classification to the Attorney V classification. Under the supervision of the Chief Counsel and in coordination with the other Assistant Chief Counsels in the Office, the Assistant Chief Counsel for Regional Board Branch 1 oversees legal aspects of four of the nine regional Water boards in a fast-paced, collegial environment.
Duties:
Plan, direct, and review the work performed by legal staff who advise four of the Regional Water Boards. Directly supervise Attorney IVs and Attorney Vs involved in the most difficult, complex and controversial water quality work and Attorneys and Attorney IIIs working on similar matters. In the absence of the Chief Counsel the individual may assume the role of the Chief Counsel to the State Water Resources Control Board and its executive staff. Specific duties include: supervise and direct attorneys of four of the nine Regional Water Boards as they advise the Regional Water Board members, management and staff in matters relating to state and federal water quality planning, enforcement, and permitting, underground storage tank and other environmental cleanup, CEQA, the Administrative Procedure Act, the Public Records Act, environmental justice, and related issues. The Assistant Chief Counsel may perform these duties directly, as well as work directly with the Regional Water Boards on legal issues related to the appointment of board members and executive officers. The Assistant Chief Counsel also assists and works with the Attorney General in litigation matters involving the Regional Water Boards and oversees the work of the Regional Water Board attorneys undertaken in support of the Attorney General’s Office. The Assistant Chief Counsel works with broad discretion and independence with minimum supervision.

Salary information – CalHR salary rules allow appointment at the entrance rate (Cal. Code Regs., tit. 2, § 599.673) of a classification. For classes with alternate ranges, placement is based on education/experience.
