Recruitment Range: $64,838 - $86,894

 


 

Department Mission: Under the Department of Commerce, the mission of the Division of Employment Security (DES) is to administer the unemployment insurance system for the state of North Carolina by delivering efficient, effective and quality service.


Description of work:
The primary purpose of this unit is to schedule, conduct hearings, and deliver a decision to claimants and employers regarding the appeals of adjudicated Unemployment Insurance (UI) claims. This position will conduct unemployment insurance and special program appeals hearing on contested cases for unemployment insurance benefits.

This posting is for three positions of Appeals Referee, whose primary job function is to preside over quasi-judicial evidentiary hearings on all manner of contested claims for UI benefits, UI fraud and requests for relief of UI benefit charges, and render decisions that, subject to further appeal to the appointed NC Board of Review or thereafter to the Courts, are the final agency decisions.  As presiding Appeals Referee, this position must provide hearing parties, witnesses and authorized legal representatives a full, fair and complete hearing on contested issues and any issues that may arise in the course of the hearing process, finding facts that are relevant and applying the appropriate law to the facts they find.  This position must provide professional, knowledgeable customer service to hearing parties, witnesses and legal representatives.

Duties of the position include: 

  • Apply the correct Division of Employment Security (DES) Law, rules and applicable case law in drafting orders and decisions.
  • Conduct assigned unemployment insurance appeals hearings so that all parties reasonably understand the process.
  • Respond to and rule on preliminary motions (for continuance, subpoena, withdrawal, etc) in accordance with Division of Employment Security (DES) rules and applicable case law.
  • Preside over quasi-judicial evidentiary hearings on all manner of contested claims for Unemployment Insurance benefits, UI fraud and requests for relief of UI benefit charges, and render decisions that, subject to further appeal to the appointed NC Board of Review or thereafter to the Courts, are the final agency decisions.
  • Be an accurate source of information about DES appeals law, rules, policy and procedure.
  • Maintain a courteous and professional demeanor under pressure.


Secondary employment requires supervisory approval.

Applicant must meet both the Minimum Education and Experience Requirements and all posted Knowledge, Skills and Abilities / Competencies requirements to be considered Qualified for the position.

 

Minimum Education and Experience Requirements

Juris Doctor from an appropriately accredited institution.


Special Requirement
Pursuant to NCGS 96-15(c) the job of Appeals Referee/ALC I requires an active license to practice law in North Carolina.
