Job Description and Duties

 

Join one of the largest and most sophisticated water infrastructure finance teams in the nation. Under the supervision of an Assistant Chief Counsel, the Attorney will work in a fast-paced, collegial transactional practice and advise on all stages of multiple complex financial assistance programs from initial eligibility through execution and post-execution compliance.

The State Water Resources Control Board’s Office of Chief Counsel has one opening for an Attorney on the Loans & Grants team. Attorneys in the Loans & Grants team advise the Division of Financial Assistance (DFA) at the State Water Resources Control Board and assist with administering DFA’s financial programs (like Safe and Affordable Funding for Equity and Resilience (SAFER), Drinking Water State Revolving Fund (DWSRF), Clean Water State Revolving Fund (CWSRF), Nonpoint Source (NPS)). These programs provide funding for safe drinking water, wastewater treatment, water recycling infrastructure, and groundwater cleanup projects in the form of loans, grants, and technical assistance support for sustainable water solutions across California.

The position is located at 1001 I Street, Sacramento, CA 95814, right in the heart of downtown next to light rail stations and other public transportation.

Duties Include:

  • Draft or review transactional documents (e.g., grants, loans, installment sale agreements, decisional file records, etc.). Correspond and negotiate with outside counsel on complex transactions.    
  • Undertake legal and financial due diligence reviews of potential recipients and counterparties, including review of corporate authority, indentures and other financial obligations, management operations (including joint powers agreements (JPAs)), and project specific risk.
  • Provide legal counsel related to existing and pending complex compliance obligations (e.g., federal grant applications, legislation, bond indentures, pending revenue bond sales, etc.).  
  • Provide legal counsel regarding existing and pending Board policies and policy implementation documents, including funding program guidelines or process documents. Collaboratively engage with stakeholders, state and federal agencies, and other interested parties and funding partners.
  • Assist the DFA with research, writing, recommendations, review, counsel, and negotiation associated with a wide range of legal issues, including real property, secured transactions, tax law, legal opinions, conflicts of interest, audits, and Public Records Act requests.
  • Occasionally participate in-person and remotely at State Water Board funding workshops, advisory groups, site visits, and stakeholder events in various locations throughout the state, including hearing rooms, meeting centers, field sites, and other locations.

Working Conditions

Salary Information - CalHR salary rules allow appointment at the entrance rate (Cal. Code Regs., tit. 2, § 599.673) of a classification. For classes with alternate ranges, placement is based on education/experience. Employees appointed to the Attorney or Water Resource Control Engineer classification will receive Recruitment Higher Above Minimum (HAM) rate in accordance with the approved Civil Service Pay Scales.

In addition, note: Effective July 1, 2025, the State of California implemented the Personal Leave Program 2025 (PLP 2025) which reduces an employee’s monthly salary in exchange for leave credits. Employees appointed to this classification will have their monthly salary reduced and will accrue hours of PLP 2025 on the first day of each pay period in accordance with the applicable bargaining contract. The salary range(s) included on this job posting do not reflect the reduction in pay.
